    The Republic of Malta consists of three islands, situated just 80 kilometres off the southern coast of Sicily, Italy, the Republic of Malta lies in the centre of the Mediterranean Sea.     Legal Framework

    Although it is a former British dependency, Maltese law is codified and there is no British ‘common law’ tradition here. Broadly speaking, the law is divided into two main branches – civil law and criminal law, both of which follow different traditions.

    The Maltese civil law is based on the Napoleonic Code, based on the older Roman law concepts; therefore, particularly in the older areas of civil law, especially those that concern property, contracts, obligations, and so on, the Maltese law is very similar to French and Italian law. A referral is often made to French and Italian authors in the interpretation of Maltese law.

    Speaking about the criminal law field, Malta has borrowed heavily from the British system and there are a lot of similarities between the two. All trials are tried by juries (except for lesser offences) and the whole system is based on the British criminal law set-up.

    As for the newer fields of law, particularly in the environmental, financial, company, and fiscal legislative areas, a major chunk of new laws have been enacted over the past ten years and these tend to be borrowed from other countries (in particular from Britain) and adapted to Maltese requirements. Today, Malta is amending its body of laws to bring it into line with the laws of the EU, of which Malta is a member.

    Citizenship by Naturalization: An Synopsis

    Malta’s Granting of Citizenship for Exceptional Services by Direct Investment Regulations (S.L. 188.05), under the Maltese Citizenship Act Cap. 188, LN437 of 2020, permit the granting of citizenship by a certificate of naturalization to foreign individuals as well as their families who contribute to the country’s economic development.

Additionally, the Community Malta Agency is the competent Maltese government agency that is responsible for administering the regulations. 

    Naturalization requirements for Maltese citizenship

    The application for Maltese Citizenship by Naturalization for Exceptional Services by Direct Investment is thoroughly examined, evaluated, and put through a four-tier due diligence procedure. The following conditions must be met in order to be eligible:

     

    • All applicants must be at least 18 years old.
    • A contribution of at least EUR 600,000 for a residency commitment of at least 36 months, or EUR 750,000 for a residency commitment of at least 12 months.
    • The purchase of a home in Malta for at least EUR 700,000, which must be retained for at least five years. Alternately, a residential property with a five-year lease and a minimum annual rental cost of EUR 16,000 may be used. It is important to remember that throughout the five-year period, the property cannot be rented. During the residency time, a 36-month (or 18-month, by exception) lease agreement or property purchase is necessary.
    • Contribution of at least 10,000 euros to a non-governmental organization or association that is registered in the fields of sport, culture, science, philanthropy, animal welfare, or the arts, as authorized by the Community Malta Agency
    • The legal residence of Malta for at least 36 months (or 12 months, by exception), which includes the lease of a residential property with a rental value of at least EUR 16,000 per annum, held for that same period. Applicants require a valid residence card in order to apply for citizenship

    The applications must all be made on the prescribed forms and should be accompanied by the appropriate fees and specific documents as called for. It is imperative that you understand the highly detailed due diligence checks that are carried out and an application will be declined if it turns out that it contains false information or omissions, so make sure everything that is included with the application is true to your knowledge. 

    If the Tier 1 checks completed by the Community Malta Agency are passed, the application for a residence permit will be submitted further. Once the residence has been obtained, an eligibility application will be submitted and further, (tiers 2, 3, and 4) checks will be made by the agency and presented to the relevant Maltese minister, who will be responsible for deciding on the applicant’s eligibility to apply for citizenship here in Malta.

    A citizenship application will be submitted to the Community Malta Agency after 36 months of residence (or 12 months by exception). Once the minister has made the decision to grant citizenship to the applicant, the applicant will then be required to fulfil the exceptional investment, donation, and property requirements. After the process is completed and checked completely, the primary applicant will be invited to take the oath of allegiance in Malta and be presented with a Maltese certificate of naturalization.

    • A donation to a non-governmental organization of EUR 2,000.
    • A non-refundable administration fee of EUR40,000
